Guide for companies and professionals in Spain
Tax advisory or gestoría: what is the difference?
A gestoría normally executes administrative filings and procedures; an advisory service interprets the context and supports decisions. Many businesses need both, with a clearly defined scope and responsibility.

The useful distinction
It is not the label that matters, but depth and responsibility
In Spain the two terms are broad and sometimes used interchangeably. What matters is the engagement: filing a return with supplied data is not the same as reviewing the decision that created the tax, comparing alternatives or coordinating the accounting and employment effects.
Gestoría
Usually focuses on administrative execution: registrations, certificates, payroll, tax returns and dealings with public bodies.
Advisory
Assesses facts, risks and alternatives to recommend a route before executing decisions with tax, accounting, employment or corporate impact.
Practical comparison
Which question does each approach answer?
| Need | Gestoría | Advisory |
|---|---|---|
| File a periodic obligation | Collects data, prepares and files the form. | Also reviews judgement, risks and the effect of relevant changes. |
| Register an activity | Executes registration using agreed information. | Compares legal form, activity codes, territory and consequences first. |
| Hire or remunerate | Prepares contracts, payroll and notices. | Assesses cost, route, risks and tax-employment coordination. |
| Invest or reorganise | Processes agreed documents and resolutions. | Models alternatives, requirements and impact before choosing. |
| Receive a tax notice | May collect and submit documents. | Analyses the technical position, response strategy and necessary evidence. |
When management may be enough
A gestoría fits when the judgement is already clear
For stable, repetitive activity without material changes, well-organised administrative execution can cover much of the need. Even then, define who reviews exceptions and when a change must be escalated to a specialist.
- Clearly defined and recurring procedures.
- Complete records supplied on time.
- No change in territory, activity or structure.
- Tax and employment positions already validated.
When advice is needed
The decision matters more than the form
- Starting an activity or choosing legal form.
- Hiring, investing or admitting shareholders.
- Operating between the Canary Islands, mainland Spain or other countries.
- Considering ZEC, RIC or other incentives.
- Changing margins, activities or remuneration.
- Facing inspections, notices or uncertain criteria.
- Coordinating tax, accounting and employment work.
- Needing scenarios before management decides.
The Advixy model
Strategy and execution should share the same context
- Define.
Which decisions need advice and which tasks recur. - Assign.
Owner, records and date for each obligation. - Escalate.
Changes reach the specialist before execution. - Review.
Calendar, risks and priorities evolve with the business.
Frequently asked questions
Choosing without confusion
Can an advisory firm also file taxes and run payroll?
Yes. Many advisory firms integrate periodic execution. The distinction lies in the agreed scope, technical review and ability to recommend before filing.
Can a gestoría provide advice?
It may have qualified professionals and offer advice. Check who analyses the case, what responsibility they assume and whether advice is included or separately engaged.
What should I ask before appointing a provider?
Ask which obligations are included, who is responsible, when records are due, how questions and changes are handled, what is excluded and when specialists intervene.
Can I change provider during the year?
Yes, but the transition should inventory returns, books, certificates, open files and pending work to prevent lost context or missed dates.
