What can be completed by videoconference
Article 17 ter of the Spanish Notaries Act lists the acts that may be authorised by videoconference. The most relevant for companies and professionals include:
- Commercial policies, subject to the statutory conditions.
- Company incorporations, appointments, commercial powers of attorney and other corporate acts where capital contributions are made in cash.
- Powers for specific acts, representation in proceedings, dealings with public authorities and electoral powers. General and preventive powers cannot be authorised through this route.
- Revocation of powers, except general preventive powers.
- Receipts of payment and cancellation of guarantees.
- General meeting minutes, reference records and signature authentication.
- Conciliation and other acts permitted by law, provided the notary considers electronic appearance appropriate.
Eligibility depends on the act, documentation, identity checks and the notary’s professional assessment. A mortgage or any transaction not expressly included should not be presented as fully online without confirmation from the notary.
Set up a company in Spain without travelling: how it works
1) Transaction design
We define the company or transaction structure, the participants, their country of residence and the applicable requirements. We confirm at the outset whether the remote route is suitable.
2) A complete file before the appointment
Advixy prepares and organises the corporate, tax, identity and representation information, coordinates missing documents and gets the file ready for the notarial review.
3) Video call in three languages
We coordinate document exchange and the appointment. The appearance can take place in English directly with the online notary, in Spanish, or in Italian with an Advixy translator joining the video call. The language arrangement remains subject to the notary’s acceptance and the requirements of the act.
4) Final video call and follow-up
Once the file is approved, the client joins the video call, completes identification and signs digitally. The client’s online time for identification before the notary and digital signing averages around 15 minutes; Advixy continues the subsequent document follow-up included in the engagement.
Requirements and limits to consider
- Electronic identification: the person signing accesses the notarial platform using a legally accepted identification method.
- Valid electronic signature: if the client does not already have one, Advixy makes the arrangements for them to obtain it and ensures it is ready before the appointment. The exact solution depends on the act and the notary’s requirements; where applicable, the law permits a signature limited to the specific document.
- Complete documentation: powers, corporate records, identification and evidence depend on the transaction.
- Suitable device and connection: the audiovisual communication and document reading must take place in an appropriate environment.
- Notarial decision: the notary may require physical attendance or refuse authorisation when the legal conditions are not met.

1) Does an online notarial signing have legal validity?
When the act is permitted, the requirements are met and the notary authorises it, the public instrument has its corresponding legal effects. It is not the same as a private electronic signature.
2) Can every notarial document be signed online?
No. Spanish law provides a specific list and conditions. The notary decides whether videoconference is appropriate for the file.
3) Can a general power of attorney be granted by videoconference?
No. Article 17 ter excludes general and preventive powers, while allowing certain powers for specific acts and other expressly listed forms of representation.
4) Do I need an electronic certificate or signature?
A legally accepted electronic identification method is required, but the client does not need to arrange the signature alone. If they do not already have a valid electronic signature, Advixy makes the arrangements for them to obtain it and ensures it is ready before the appointment. The exact solution depends on the procedure and the notary’s requirements.
5) Does Advixy act as a notary?
No. Advixy prepares and coordinates documents and provides operational support. Impartial advice, legality checks and authorisation belong exclusively to the notary.
6) Which languages are available for the online notarial signing?
